It still can be a good solution to avoiding foreclosure. One of the main advantages of using an IRA or 401k is you have up to 60 months to pay it back if you take a loan from the account, There are no credit checks, whatever you choose to do, you will be able to do it since It is your money.&lt;br /&gt;The loan payment is deducted from your paycheck. You can get up to 50% of your retirement money or $50,000 which ever is less if you get a loan and as long as you do not default on your payments, you will not have to pay any penalties. You can also be eligible for what they call a hardship distribution, but will have to pay income tax on the money.&lt;br /&gt;The reason why I said that you have to be careful in the beginning is because taking money out of your 401k can be a bad solution if you are getting close to your retirement. You will have to pay it back with interest if you lose your job and default on the loan. If you qualify for a hardship distribution you will still have to pay income tax on the money if you decide to just take cash withdrawal, you will have to pay IRS the 10% penalty along with income tax.&lt;br /&gt;If tapping into your 401K or IRA to avoid foreclosure is your last resort, then taking out a loan from your 401k would be the better choice. At least you will be putting the money back with interest. It's a possibility that they will ask you for this information over the phone on the first point of contact and you will want to be prepared. You will also need to have some type of income in order to qualify for a loan modification. Your income will have to cover your monthly expenses plus your proposed mortgage payment. You will want to show that you have enough income by supplying information like Car fuel, groceries, utilities, credit cards, cell phone, car insurance, etc. If you do not have an income, then you will not have to worry about this.&lt;br /&gt;&lt;br /&gt;The next thing that you are going to provide is information about hardship. This consists of information like illness, job loss, and any other payments that have adjusted resulting to no longer being able to afford it. Never type this information. You don't have to look professional; just write this letter on a piece of paper. If you were laid off, then you will want to include the exact date. This also includes any illnesses whether it's yours or a family member that you have to take care of. You will also want to include information about any deaths in the family.&lt;br /&gt;&lt;br /&gt;Now you can contact your mortgage company. If you have more than one mortgage company then you will need to contact both lenders. Ask for the loan modification department or someone in charge of modifying loans. Tell them what your situation is; they may be able to walk you through the process themselves. You will be requesting the following information to put the loan modification together; payment deferment, modify your interest rate, lower your principal payment to the present market value, or ask them to put both the first and second mortgage together (This is if you have a first and second mortgage with the same lender).This will all depend on the mortgage company you're negotiating with.&lt;br /&gt;&lt;br /&gt;This next step is going to be very important. You will need to make it a point to follow up with the lender on a consistent basis. Ask them to assign a case worker to you. You will want to call at least twice a week, especially if you are in foreclosure.&lt;br /&gt;&lt;br /&gt;The only unfortunate thing about modifying your loan is if you do not have an income. You may not qualify if there is no income. Remember, you still have to pay for the loan. However, you will still want to try to contact your mortgage lender anyway and give them an explanation as to how you are going to get back on your feet.
